Acceptance of These Terms

By using the Drowsie Sleep Club app, purchasing a subscription, or using the Drowsie Bluetooth pillow speaker, you agree to these Terms of Service. If you do not agree, do not use the service.

About Drowsie

Drowsie Sleep Club is operated by Drowsie Pty Ltd (Australia). The service includes the Drowsie Sleep Club mobile app (subscription) and the Drowsie Bluetooth pillow speaker (hardware).

Subscription and Billing

  • The Drowsie Sleep Club app is offered as an annual subscription of $69/year (AUD unless stated otherwise).
  • Payments are processed by Stripe and RevenueCat.
  • Subscriptions renew automatically unless canceled before the renewal date.
  • You can manage or cancel your subscription in the app or through the platform where you subscribed.

Consumer Guarantees (Australia)

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits your rights under the ACL.

Medical Disclaimer

Drowsie is designed for relaxation and is not a medical device. Consult a healthcare professional for tinnitus treatment or any medical concern.

Acceptable Use

  • Do not misuse the app or interfere with its normal operation.
  • Do not attempt to access or reverse engineer non-public systems or data.
  • Use the service in compliance with applicable laws.

Intellectual Property

All content, trademarks, and software associated with Drowsie are owned by Drowsie Pty Ltd or its licensors. You may not copy, distribute, or create derivative works without written permission.

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Service Changes and Availability

We may modify, suspend, or discontinue parts of the service at any time. We will make reasonable efforts to provide notice for significant changes.

Limitation of Liability

To the extent permitted by law, Drowsie Pty Ltd will not be liable for indirect, incidental, special, or consequential damages. This limitation does not apply where liability cannot be excluded under the ACL.

Termination

We may suspend or terminate access to the service if you breach these Terms. You may stop using the service at any time.

Governing Law

These Terms are governed by the laws of Australia. Any disputes will be handled in the courts of Victoria, Australia, unless required otherwise by law.
